These Terms of Service ("Terms") are a binding agreement between you and Katha ("Katha", "we", "us", or "our"), operated from Ontario, Canada. They govern your access to and use of our website and matchmaking services (the "Service"). Please read them carefully. Section 14 (Dispute Resolution) requires most disputes to be resolved by binding arbitration on an individual basis and waives your right to a jury trial and to participate in class actions, to the extent permitted by law.
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old, single and legally free to marry, and able to form a binding contract. By using the Service you represent and warrant that all of these are true, that you are not barred from using the Service under any applicable law, and that you have never been convicted of a felony or a crime involving violence or a sexual offense.
You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for all activity under your account and for keeping your credentials confidential. Notify us promptly of any unauthorized use. You may not create more than one account, create an account for anyone else without their authority, or transfer your account.
Katha helps you discover and connect with potential matches using profile information and Vedic compatibility tools. We do not promise or guarantee that you will find a match, form a relationship, or marry, or that any match is compatible, honest, safe, or suitable. Compatibility scores and Kundli reports are provided for cultural and informational purposes and are not advice or a prediction of any outcome.
Some features require a paid subscription. Prices are shown at checkout in Canadian dollars unless stated otherwise. Subscription plans automatically renew at the end of each billing period at the then-current rate, and your payment method is charged automatically, until you cancel. Lifetime plans are a single one-time payment and do not renew.
You can cancel at any time from the Settings page or the Stripe billing portal. When you cancel, you keep premium access until the end of the current billing period, and you will not be charged again. Except where required by law, payments are non-refundable, and cancelling does not entitle you to a refund for the current period. We may change prices or plan features on a going-forward basis with notice; changes do not affect the period you have already paid for.
You retain ownership of the photos, text, and other content you submit ("User Content"). You grant Katha a worldwide, non-exclusive, royalty-free license to host, store, display, and use your User Content as needed to operate and provide the Service. You are solely responsible for your User Content and represent that you have the rights to it and that it does not violate any law or these Terms.
You agree not to: create a false or impersonating profile; harass, abuse, threaten, or defraud anyone; solicit money or promote a business; post content that is unlawful, obscene, hateful, or infringing; collect or misuse other members’ information; attempt to circumvent security, rate limits, or paywalls; or use the Service for any purpose other than seeking a genuine matrimonial connection. We may remove content and suspend or terminate accounts that violate these Terms.
You are solely responsible for your interactions with other members. Katha is a venue that helps members connect; we do not control and are not responsible for the conduct of any member, online or offline. We do not conduct criminal background checks or identity verification beyond the limited checks described in Section 8, and we do not screen members for criminal history. You should use your own judgment, take reasonable safety precautions, and never send money or share financial information with other members. To the fullest extent permitted by law, you assume all risk arising from your interactions with other members, and you release Katha from any claims arising out of those interactions.
Our optional verification confirms limited identity information (for example, that a submitted ID appears to match a selfie) as reviewed by our staff. A "verified" badge is not a guarantee of a member’s identity, character, intentions, criminal history, or safety, and you should not rely on it as such.
The Service, including its design, text, graphics, logos, and software, is owned by Katha or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service without our permission.
The Service relies on third-party providers (for example, for payments, hosting, and astrology calculations). We are not responsible for third-party services, and your use of them may be subject to their own terms.
You may delete your account at any time from the Settings page. We may suspend or terminate your account, with or without notice, if you violate these Terms, create risk or legal exposure for us, or for any lawful reason. Sections that by their nature should survive termination (including Sections 5, 7, and 12 through 16) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any information (including compatibility scores) is accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, KATHA AND ITS OWNERS, OFFICERS, AND STAFF WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR YOUR INTERACTIONS WITH OTHER MEMBERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) CAD $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Please read this section carefully; it affects your legal rights. First, we both agree to try to resolve any dispute informally by contacting us at team.covru@gmail.com and allowing 30 days to resolve it.
If we cannot resolve a dispute informally, then to the fullest extent permitted by applicable law, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration on an individual basis, and not in a class, collective, or representative proceeding. You and Katha waive the right to a jury trial and the right to participate in a class action, to the extent permitted by law. Nothing in this section prevents either party from seeking relief in small-claims court for qualifying claims.
This arbitration agreement does not apply where prohibited by the consumer-protection law of your province, state, or country. In that case, and for any dispute not subject to arbitration, the courts located in Ontario, Canada will have exclusive jurisdiction, and you consent to that jurisdiction and venue.
You agree to indemnify and hold harmless Katha and its owners, officers, and staff from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, your interactions with other members, or your violation of these Terms or any law.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. These Terms and the Privacy Policy are the entire agreement between you and Katha regarding the Service.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after an update means you accept the revised Terms.
